Understanding Post-Delegation Dispute Resolution Procedures

Post-Delegation Dispute Resolution Procedures have been developed to provide those harmed by a new gTLD Registry Operator's conduct an alternative avenue to complain about that conduct. All such dispute resolution procedures are handled by providers external to ICANN and require that complainants take specific steps to address their issues before filing a formal complaint. An Expert Panel will determine whether a Registry Operator is at fault and recommend remedies to ICANN. Currently, there are three Post-Delegation Dispute Resolution Procedures:

  1. Trademark Post-Delegation Dispute Resolution Procedure (Trademark PDDRP)
    The Trademark PDDRP generally addresses a Registry Operator's complicity in trademark infringement on the first or second level of a New gTLD. At least 30 days prior to filing a formal complaint, a rights holder must notify the Registry of the alleged infringing conduct and express a willingness to meet to resolve the issue.   2. Registry Restriction Dispute Resolution Procedure (RRDRP)
    The RRDRP is intended to address circumstances in which a community-based New gTLD Registry Operator deviates from the registration restrictions outlined in its Registry Agreement. An RRDRP complaint may only be filed by an established institution. Prior to filing a formal RRDRP proceeding, a complainant will be required to utilize an online complaint system (in development) similar to the current Whois Data Problem Report System.   3. Public Interest Commitments Dispute Resolution Procedure (PICDRP)
    The PICDRP addresses complaints that a Registry may not be complying with the Public Interest Commitment(s) in Specification 11 of their Registry Agreement. Prior to filing a formal PICDRP proceeding, the procedure envisions that a complainant will be required to utilize an online complaint system (in development) similar to the current Whois Data Problem Report System. 02 December 2014 — Seeking Panel Members for Public Interest Commitment Dispute Resolution

ICANN plans to expand the Standing Panel responsible for administering the Public Interest Commitment Dispute Resolution Procedure (PICDRP), which supports the New gTLD Program. Parties with relevant experience and the desire to serve the Internet community are invited to submit expressions of interest.

04 June 2012 — Trademark PDDRP and Registration Restriction DRP

The Trademark Post-Delegation and Registration Restriction Dispute Resolution Procedures are approved as part of the Applicant Guidebook.

15 March 2013 — Public Comment: Draft Public Interest Commitments Dispute Resolution Procedure (PICDRP)

ICANN solicits feedback on the Draft PICDRP, which is intended to hold a Registry Operator accountable if it fails to abide by the Public Interest Commitment(s) set forth in its Registry Agreement with ICANN.

30 April 2013 — ICANN Seeks Service Providers for Two Post-Delegation Dispute Resolution Procedures

ICANN issued Requests for Proposals to identify potential providers of Registration Restriction DRP and Trademark PDDRP services. Candidates are expected to meet the requirements outlined in the respective RFPs.

02 August 2013 — First PDDRP Providers

The National Arbitration Forum (FORUM) is appointed as the first Registration Restrictions Dispute Resolution Procedure (RRDRP) service provider, and both The Asian Domain Name Dispute Resolution Centre (ADNDRC) and FORUM will provide Trademark Post-Delegation Dispute Resolution Procedure (Trademark PDDRP) services.

20 August 2013 — Additional Post-Delegation Dispute Resolution Procedure Provider

The World Intellectual Property Organization (WIPO Center) and ICANN sign a Memorandum of Understanding establishing the WIPO Center as a Trademark PDDRP service provider.

2 October 2013 — Public Comment Open: Revised Public Interest Commitment Dispute Resolution Procedure

The revised version of the Public Interest Commitment Dispute Resolution Procedure (PICDRP) incorporates community feedback provided on the 15 March 2013 Draft PICDRP Requirements [PDF, 198 KB].

Public Interest Commitment Dispute Resolution Procedure Finalized

After undergoing an initial Public Comment period (March 2013) and an additional Public Comment period (October 2013), the Public Interest Commitment Dispute Resolution Procedure (PICDRP) has been finalized and is now available.

Post-Delegation Dispute Resolution Procedures Rules Updated

The Rules for the Trademark Post-Delegation Dispute Resolution Procedure (Trademark PDDRP) and Registry Restriction Dispute Resolution Procedure (RRDRP) are now available for download.
